Matthew B. Byrne and Robert B. Hemley were members of the legal team that successfully challenged the constitutionality of Vermont statutes as preempted under the Atomic Energy Act. The case was tried before Judge J. Garvan Murtha in the United States District Court. The Second Circuit Court of Appeals affirmed Judge Murtha’s decision. A copy of the decision is here.
