On March 31, 2023, the Office of Federal Contract Compliance Programs (“OFCCP”) opened the contractor portal for 2023 Affirmative Action Plan (“AAP”) certification. Covered federal contractors must use the portal to certify that they have maintained an AAP. As part of the updated portal, covered federal contractors will need to provide the start date of their AAP.
How to Certify an AAP on the OFCCP Portal
Companies must certify their 2023 AAP by June 29, 2023. Companies are not required to upload their AAPs at this time, only to certify that they have an active AAP in place.

Do I need an AAP?
A company needs an AAP if they meet one of the following thresholds:
- If a company has more than fifty (50) employees and a government contract that can be reasonably expected to total $50,000;
- If a company is issuing and paying agents for U.S. Savings Bonds and Notes in any amount; or
- If a company serves as depository of Government funds in any amount.
